Terms and Conditions of Participation for the Competition "Vienna Adventcalendar"

What can I win?

The prize is specified in the respective contest description. Prizes cannot be exchanged or redeemed for cash. Prizes are non-transferable to third parties. In the case of services (e.g., hotel bookings, flight tickets, etc.), the timing or period of use depends on the availability of the respective service. The prize must be redeemed within one year; otherwise, it will expire.

Start and end of the contest

The start and end of the contest, as well as the date of the drawing, are specified in the respective contest description.

Who can participate?

Only natural persons who have reached the age of 18 are eligible to participate. Employees of the Vienna Tourist Board and their relatives are excluded from participation. Participation via contest clubs or automated services is not permitted.

How are the winners determined?

Unless otherwise specified, winners are determined by random selection. Exceptions will be communicated in the contest description (e.g., selection of the winner by a jury, etc.). If a winner does not respond within 2 days of being notified, the claim to the prize will expire without substitution. There is no obligation to accept the prize.

How are the winners notified?

Winners will be notified immediately after the contest ends via the email address provided by the participant. The prize will be sent by mail or alternatively by email.

What happens to my data?

By participating in the contest, you consent to the collection and processing of your personal data for the purpose of conducting and managing the contest and notifying you in case of a win. Providing this information is necessary to participate in the contest. We will store your data until the winners are determined. You may withdraw your consent at any time by sending us a notification. Your data will then be deleted.

In the event of a win, we will process your data (name, address) to deliver and utilize the prize, and it will be deleted after the statutory retention period of 10 years.

Personal data will only be shared with contest partners (e.g., airline, hotel, etc.) in the event of a win to facilitate prize processing.

The Vienna Tourist Board explicitly states that no personal data will be shared with third parties. Exceptions include the transmission of data as part of contract processing, such as sending and storing emails or storing data in a secure data center. These are processors under Article 4, Point 8 of the GDPR, who are carefully selected and contractually bound to adhere to the same data protection standards. Processors only have access to your data to the extent and for the duration necessary to provide their services or to the extent that you have consented to the processing and use of your data.

What happens if a condition of participation is or becomes invalid?

In such cases, the validity of the remaining provisions remains unaffected. An appropriate regulation will replace the invalid provision and will most closely reflect the purpose of the invalid provision.

Which law applies?

The contest is exclusively subject to Austrian law. The place of performance and jurisdiction is Vienna. The application of the UN Convention on Contracts for the International Sale of Goods, as well as international conflict-of-law rules, is excluded.

Legal recourse and liability

Legal recourse is excluded. There is no enforceable claim to the prize. The organizer is not liable for any direct or indirect damages resulting from participation in the contest, the drawing, or the unavailability of the internet server unless such damages are due to gross negligence or intentional actions of the legal representatives, employees, or agents of the organizer. Furthermore, the organizer assumes no liability for any data loss, particularly during data transmission or other technical defects that may affect the contest results or participation in the contest.
